What is Escrow Account?
A Dubai off-plan escrow account is a regulated third-party bank account where buyer payments for an off-plan project are held in trust. Under RERA Escrow Law (Decree No. 8 of 2007), every Dubai off-plan developer must open a project-specific escrow account with a RERA-approved escrow agent (typically a UAE bank). All buyer payments — down payments, milestone instalments, handover payments — are deposited into the escrow account, not directly to the developer. The escrow agent releases funds to the developer only against verified construction-progress milestones (independently inspected). The remaining 5% is held until 12 months after handover (to cover any defects). This system protects buyers: if the developer becomes insolvent or fails to build, buyer funds are protected and can be refunded. The escrow law was introduced after the 2008–2009 Dubai property crisis when several developers absconded with buyer funds.
Example
A buyer pays AED 200,000 down payment on an Emaar off-plan SPA. The cheque is deposited into Emaar's project-specific escrow account at Emirates NBD (the escrow agent). Emaar can't access the funds until construction milestones are independently verified. If Emaar fails to build, the buyer's AED 200,000 is refunded from the escrow account.

Yes — RERA mandates this for every off-plan project marketed in Dubai. Always verify the project's RERA registration and escrow account before paying any deposit. Unregistered "off-plan" offers (often unofficial pre-launches) carry significant fraud risk.
Can I claim my money back from escrow if I want to cancel?+
Yes, but with penalties. Standard SPAs allow buyer cancellation with forfeiture of 10–25% of paid amounts depending on construction progress. Pure-default refunds (without penalty) only apply when the developer breaches the SPA materially.
